These Terms of Service, along with the Privacy Policy and Refund Policy (collectively, the “Terms”), govern your use of DivTracker ("the App"), a web-based application and a mobile application and related services created and operated by Boldizsár Tömpe E.V. ("We"). The App is available to you through this site, the mobile application available on the App Store, and other means. By accessing, using or downloading any materials from the App, you agree to follow and be bound by the Terms, which may be updated by us from time to time without notice to you. You can review the most current version of the Terms at any time here. We and third party providers may make improvements and/or changes in the products, services, mobile applications, features, programs, and prices described in this App at any time without notice. Certain provisions of the Terms may be supplemented or superseded by expressly designated legal notices or terms located on particular pages at this App. If you do not agree with the Terms, please do not use this App. BY CONTINUING TO USE THE APP, YOU ARE INDICATING YOUR AGREEMENT TO THE TERMS AND ALL REVISIONS THEREOF.
If you choose to buy a DivTracker Pro or Ultimate subscription on the website, payment will be charged to your given card information on purchase. If you are unhappy with the product received, you may be eligible for a full/partial refund. For more information, please review our Refund Policy
If you choose to buy a DivTracker Pro or Ultimate subscription on Apple's App Store, payment will be charged to your Apple ID account at the confirmation of purchase. The subscription automatically renews unless it is canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel your subscriptions by going to your account settings on the App Store after purchase. All purchases are final. We cannot issue refunds for purchases charged to your Apple ID. If you are unhappy with the product received, you may be eligible for a refund. We are not capable of issuing refunds, however you can follow the instructions on Apple's website
You acknowledge and agree that the App and any necessary software used in connection with the App (if any) contain proprietary and confidential information that is protected by applicable intellectual property and other laws. Except as expressly permitted by applicable law or authorized by us or applicable third party service providers or advertisers, you agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on the App, the software or Content available on the App (other than Content that you may submit), in whole or in part.
We grant you a personal, non-transferable and non-exclusive right and license to access and use the App; provided that you do not (and do not allow any third party to) copy, modify, create a derivative work from, reverse engineer, reverse assemble, or otherwise attempt to discover any source code, sell, assign, sublicense, grant a security interest in or otherwise transfer any right in the App. You agree not to access the App by any means other than through the interface that is provided by us for use in accessing the App.
No warranty is provided for the Application that is not executable on the device, that has been unauthorizedly modified, handled inappropriately or culpably, combined or installed with inappropriate hardware or software, used with inappropriate accessories. The information contained in this application is for informational purposes only and we do not take any responsibility for any monetary gains or losses caused by information provided by this application.
When users choose to connect their brokerage accounts to our application for enhanced functionality and personalized insights, it is important to note that we rely on third-party providers for brokerage integration. We strive to offer support for a wide range of brokerages; however, we cannot guarantee the compatibility of all brokerage accounts.
Third-Party Reliance: Our brokerage integration is dependent on third-party providers, and the availability of supported brokerages is subject to the APIs and services provided by these external entities.
Unsupported Brokerages: We cannot guarantee support for all brokerage accounts, and some brokerages may not be compatible with our integration due to restrictions imposed by the third-party providers or other technical limitations.
Changes in Brokerage Support: The list of supported brokerages may change over time based on decisions made by the third-party providers or other unforeseen circumstances. We will make reasonable efforts to update our support list accordingly.
Users who connect their brokerage accounts through Plaid acknowledge and agree to abide by the terms outlined in Plaid's End User Services Agreement. The full text of the agreement can be found at Plaid's End User Services Agreement.
Users who opt for brokerage integration via SnapTrade acknowledge and accept the terms specified in SnapTrade's Terms of Service. The complete details of SnapTrade's Terms of Service can be accessed at SnapTrade End User Terms and Conditions.
Review of Third-Party Agreements: Users are responsible for reviewing and understanding the terms and conditions of both Plaid's End User Services Agreement and SnapTrade's Terms of Service before initiating the brokerage integration process.
Acceptance of Third-Party Terms: By connecting their brokerage accounts through Plaid or SnapTrade, users automatically accept the terms of the respective third-party provider's end user agreement.
Disclaimer: We do not assume liability for any disputes, issues, or concerns arising from the use of Plaid or SnapTrade for brokerage integration. Users acknowledge that the terms and conditions set forth by Plaid and SnapTrade are separate from our own terms and are governed by the respective third-party providers. By proceeding with brokerage integration via Plaid or SnapTrade, users confirm their understanding and acceptance of the third-party end user agreements associated with their chosen integration method. It is recommended that users familiarize themselves with the provided links to the third-party agreements for a comprehensive understanding of the terms and conditions.
On the mobile App initially, all your data is stored locally on your devices and in your iCloud account. Your information remains on the device until you choose to create an account with us. Once you create an account using your email and password, your data will be securely stored on our servers. We will only store data that is essential for the app's functionality, such as portfolio or holding data. On the web-based App, account creation with us is needed to use the App.
We make every effort to ensure that the data provided in the app is accurate and up-to-date. However, we rely on third-party sources to provide this data and cannot guarantee its accuracy or completeness. Therefore, we accept no liability for any loss, direct or indirect, you may experience as a result of relying solely on the data provided in the app. We strongly advise you to verify any information in the app with other sources before making any investment decisions.
This Agreement, along with any dispute or claim arising from or related to it, including its subject matter or formation, shall be subject to and interpreted in accordance with the laws of Hungary. The parties mutually and irrevocably consent that the courts in Budapest, Hungary, shall possess exclusive jurisdiction to resolve any disputes or claims arising from, or related to, the Agreement, its interpretation, validity, enforcement, or formation.
